Please read these Terms of Service ("Terms") carefully before enrolling in or using any classes, programs, facilities, or services offered by UpendraSwimAcademy ("we," "us," "our," or the "Academy"). By registering for a class, booking a session, or using our website, you ("you," "the Client," or, if enrolling a minor, "the Parent/Guardian") agree to be bound by these Terms.

Acceptance of Terms
By registering for any program, class, camp, or private lesson, or by using our website or facilities, you confirm that you have read, understood, and agree to these Terms. If you are enrolling a child or another individual, you confirm that you are their parent or legal guardian, or otherwise authorized to agree to these Terms on their behalf.

Services Provided
UpendraSwimAcademy provides swim instruction, coaching, and related aquatic programs, which may include group lessons, private lessons, camps, competitive team training, and related events ("Services"). Class schedules, instructors, pricing, and locations are subject to change at our discretion, and we will make reasonable efforts to notify you of any material changes.

Enrollment and Registration
Enrollment is confirmed only upon receipt of a completed registration form and applicable payment. Participants must accurately disclose relevant medical conditions, allergies, disabilities, swimming ability, and any other information reasonably necessary for safe participation. We reserve the right to place participants in a class level based on our assessment of their skill and safety needs, regardless of the level requested at registration. We reserve the right to refuse or cancel enrollment at our discretion, including for incomplete information, capacity limits, or safety concerns.

Fees and Payment
All fees must be paid in full at the time of registration unless a payment plan has been explicitly agreed to in writing. Prices are subject to change for future terms or sessions; changes will not apply retroactively to sessions already paid for. Cancellation, Refund, and Make-Up Policy
Cancellations by the Client: [Insert notice period, e.g., "Cancellations made at least 48 hours before a scheduled session are eligible for a credit or make-up class. Cancellations made after this window are non-refundable."] Cancellations by the Academy: If we cancel a class due to instructor unavailability, weather, facility issues, or other circumstances, we will offer a make-up session or credit at our discretion. Refunds: Refunds are not provided for classes missed without prior notice 2 hrs before scheduled time, but may be issued at our discretion for medical or extenuating circumstances upon written request. Weather/Facility Closures: We are not responsible for cancellations due to circumstances beyond our reasonable control, including pool closures, extreme weather, power outages, or government orders.
Attendance and Punctuality
Participants are expected to arrive on time and ready to participate. Persistent lateness or absence may affect placement, progress, and eligibility for make-up sessions. Missed classes are generally not eligible for refunds but may be eligible for make-up sessions per our make-up policy above.
Health, Safety, and Assumption of Risk
Swimming and related aquatic activities carry inherent risks, including but not limited to drowning, slipping, muscle strain, and other injury, even with proper instruction and supervision. By enrolling, you acknowledge and voluntarily assume these risks on behalf of yourself and/or the participant you are enrolling. You represent that the participant is physically able to participate in swim instruction, and you agree to inform us promptly of any change in health status, medication, or physical condition that may affect participation or safety. Participants must follow all posted facility rules and the reasonable instructions of coaches and staff at all times. Upendra Swim Academy reserves the right to remove any participant from a class or facility if their behavior or condition poses a safety risk to themselves or others.
Code of Conduct
We expect all participants, parents, and guardians to treat coaches, staff, and other participants with courtesy and respect. We reserve the right to suspend or terminate enrollment, without refund, for conduct that is abusive, disruptive, unsafe, or otherwise inconsistent with the values of our program.
Photo, Video, and Testimonial Release
Unless you notify us in writing that you opt out, you consent to Upendra Swim Academy photographing or video recording participants during classes and events, and using such photos, videos, and any written feedback or testimonials you provide for promotional purposes, including on our website, social media, and marketing materials. You may withdraw this consent at any time by contacting us in writing; withdrawal will apply to future use only.
Website Use and Intellectual Property
All content on our website and marketing materials, including text, graphics, logos, videos, and instructional materials, is the property of Upendra Swim Academy or its licensors and may not be copied, reproduced, or distributed without our prior written consent.
Limitation of Liability
To the fullest extent permitted by law, Upendra Swim Academy, its owners, employees, coaches, and agents shall not be liable for any indirect, incidental, or consequential damages arising from participation in our programs or use of our facilities, except to the extent caused by our gross negligence or willful misconduct. Our total liability for any claim arising from these Terms or our Services shall not exceed the amount paid by you for the Services giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Upendra Swim Academy and its owners, employees, coaches, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your or the participant's breach of these Terms or participation in our Services, except where caused by our gross negligence or willful misconduct.
Changes to These Terms
We may update these Terms from time to time. Continued enrollment or use of our Services after changes are posted constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
Governing Law
